This Privacy Policy reflects the categories of personal information which we disclose, and the way we share your personal information for the purpose of targeted advertising.

Introduction

Welcome to Hyperlith, LLC (DBA’s Brazos Gold Works, Atali Trade and Circe) (collectively, the "Company," "we," "us," and "our"). We respect the privacy of our users ("user" or "you") and have adopted this Privacy Policy to show our commitment to protecting your privacy.  This Privacy Policy describes the types of personal information we collect, as well as how it’s used disclosed, protected, and retained through our website from which you are accessing this Privacy Policy, our social media pages on third-party social media platforms, email, text, mail, and any offline business interactions you have with us (collectively, our “Services”).  It also explains your privacy choices and rights, as well as how to exercise them.  

By accessing or using our Services, you signify your acceptance of this Privacy Policy and consent to the collection, use, disclosure, and other handling of your personal information as described in this Privacy Policy (except for activities for which we first require your consent to be given through other means).

The following four (4) sections serve as Hyperlith’s Notice at Collection Under applicable US privacy laws, including the California Consumer Privacy Act (“CCPA”).

Collection of Personal Information

The Company collects and processes different types of information about you, including information that identifies, relates to, describes, or can be associated with you (known as “personal information”).  This includes information that we collect directly from you, through automated collection technologies, from other sources, or personal information we derive based on other types of personal information we collect, as more fully described below.

We have collected the following categories of personal information.  Note that not all categories may be collected about every individual:

  1. Identifiers, such as “contact information” (e.g., name, alias, postal address, unique personal identifier, email address, customer number, date of birth, demographic information, IPO addresses, and other online identifiers).
  2. Commercial Information (e.g., transaction information such as order details, amount charged, payment method, purchase history records of products purchased or considered or other purchasing or consuming histories or tendencies, reviews you submit)
  3. Internet or Network Activity (e.g, browsing history, interactions with our website, clicks)
  4. Geolocation date (e.g., devise location)
  5. Professional or Employment-Related Information (e.g., work email)
  6. Personal Information Categories Listed in the California Customer Records Statute (e.g., name, address, telephone number, personal characteristics or description, employment; some of this information may overlap with other categories)
  7. Inferences drawn from any of the Personal Information listed above to create a profile about, for example, an individual’s preferences (e.g., preferences, interests, and characteristics)
  8. Sensitive personal information (in limited circumstances and described further below)

Business Contacts, Vendors, and Contractors.  We may also collect limited personal information from our business contacts, vendors, and contractors.  For example, we collect name and business contact information (including name, job title, telephone number(s), and email address) from each of our business contacts, vendors, and contractors for the purpose of initiating, operating, managing, and maintaining our business relationships.  For our business contacts, such as our dealers, we may also collect purchase or consuming histories as part of that relationship.

Sensitive Personal Information

While we do not collect or process precise geolocation through our website or online services, our service providers may collect such information which may be considered “sensitive personal information” or “sensitive data” within the meaning of US privacy laws.  In most other cases, we do not ask you to provide, and we do not knowingly collect, any sensitive personal information (as defined under US privacy laws) from the typical consumer as part of the Services (e.g., social security numbers, information related to racial or ethnic origin, political opinions, religion or other beliefs, health, biometrics or genetic characteristics, criminal background, or trade union membership).  Unless we request it, we ask that you do not send us, and you do not disclose, any sensitive personal information on or through the Services or otherwise to us.  

We do not “sell” or “share” sensitive personal information about Californians or other state residents within the meaning of the CCPA and other US privacy laws and do not use “sensitive personal information” for any purposes that are incompatible with the disclosed purpose for which it was collected or other than those permitted purposes authorized by US privacy law.  We do not use sensitive personal information for inferring characteristics about you.

Use of Personal Information

We and our service providers, contractors, and third parties use your personal information for the following purposes:

  1. Provide, operate, and maintain our website
  2. Fulfill orders and process returns that you have ordered or requested, and to communicate about such orders or returns
  3. Enable and improve customer service and address your questions, suggestions, compliments, or complaints
  4. Communicate with you, including sending you important information regarding the website or terms, conditions, policies, recall information and/or other administrative information

We may also aggregate and/or anonymize personal information so that it will no longer be considered personal information.  We do so to generate other data for our use, which we may use and disclose for any purpose, as it no longer reasonably identifies you or any other individual.

We may disclose, share, or sell your personal information to service providers, contractors, and third parties for the following purposes:

Retention of Personal Information

Location Information.  This website collects real-time information about the location of your device.  You can choose whether to allow the website to collect and use real-time information about your device’s location through the device’s privacy settings. If you block the use of location information, some parts of the website may then be inaccessible or not function properly.
  3. Usage Information.  We and our service providers and third parties may collect information about your user activity of our services and browser habits via cookies, web beacons, pixel tags, and other tracking technologies about your online activity, and interactions with our emails, online, and mobile advertisements.  

The information we collect automatically may include personal information or we may maintain it or associate it with personal information we collect in other ways or receive from third parties.  It helps us to improve our website and to deliver a better and more personalized service by enabling us to estimate our audience size and usage patterns, store information about your preferences, to customize our website according to your individual interest, and to recognize you when you return to our website, and we use it for the other purposes described in this Privacy Policy as well.

We may receive personal information about you from other sources.  We may combine that with information we have already collected from you to use for all the purposes described in this Privacy Policy.  For example, we may collect personal information about you from social media providers, including if you interact with us through a social media service or log in using social media credentials.

We seek to use various organizational, technical, and administrative measures to protect personal information without our organization.  Unfortunately, no data transmission or storage system can be guaranteed to be 100% secure.

We have created the following mechanisms to provide you with control over your personal information.  

  1. Opt-Out of Email Communications.  If you no longer want to receive marketing-related emails from us on a going-forward basis, you may opt-out by clicking the “unsubscribe” link at the bottom of any marketing email.  Please allow 10 days for the change to take effect.  Note that if you opt-out of receiving marketing-related emails from us, we may still send you important administrative messages, from which you cannot opt-out.
  2. Opt-Out of Text Communications.  You can opt-out of receiving further marketing text messages by responding to any of our text messages with any of the following replies: STOP, END, CANCEL, UNSUBSCRIBE, or QUIT.
  3. Manage Tracking Technologies and Advertising.  We use several modern marketing tools in support of our advertising efforts.  You can manage how your device, mobile browser, and other devices share information with our website, as well as how your browser handles cookies and other tracking technologies to collect information in connection with our services and our advertisements.  You may be able to block cookies on your browser.  However, note that by blocking any or all cookies, you may not have access to certain services features or offerings.

This Privacy Policy does not apply to information collected by third-party websites that may be accessible through the Services.  The inclusion of a link on the Services does not imply endorsement of the linked site or service by us or by our affiliates.

Third-Party Payment Services

We use a third-party payment service to process payments made through the Services.  If you wish to make a payment through the Services, your personal information will be collected by such third party and will be subject to the third party’s privacy policy, rather than the Privacy Policy.  We have no control over, and are not responsible for, this third party’s collection, use, and disclosure of your personal information.

Use of Services by Minors

Our Services are not intended for children under the age of 16, and children under the age of 16 are not permitted to use our Services.  We do not knowingly collect information online from individuals under the age of 16.  If we obtain actual knowledge that any information we collect has been provided by a child under the age of 16, we will promptly delete that information.

Updates to this Privacy Policy

The “Last Updated” legend at the top of this Privacy Policy indicates when this Privacy Policy was last revised.  Any changes will become effective when we post the revised Privacy Policy on the Services.  We will notify you if the policy changes in any material way by placing a prominent notice on our website.
